You can cancel the SMS service at any time by replying STOP to any message. We will send a confirmation that you have been unsubscribed, and you will receive no further SMS messages from us. These Terms of Use are governed by the laws of the State of Texas, without regard to its conflict of law provisions. You and the Company consent to the exclusive jurisdiction of the state and federal courts located in Texas for any claim or dispute arising out of these Terms of Use. If any provision is found invalid, the remaining provisions remain in full force and effect. Any controversy, dispute, demand, claim, or cause of action between you and the Company (including the interpretation and scope of this clause) shall be settled exclusively through binding and confidential arbitration, except that either party may bring qualifying claims in small claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent infringement or misappropriation of its intellectual property. There is no judge or jury in arbitration, and arbitration procedures are simpler and more limited than court rules. The claimant pays the filing fee to initiate arbitration; the Company pays arbitration costs as required by the JAMS rules. Each side pays its own attorneys' fees and costs unless the applicable law provides otherwise.
